Opinion: Trans youth exist – it is time to recognize their rights and respond to their needs

Trans people exist. In any functional democratic society, we must agree on principles as prerequisites to any debate. One such principle in our country is the following: trans people have rights.

The French Republic recognizes gender identity as a ground of discrimination punishable under the penal code (art. 225-1) and limits freedom of expression with respect to incitement to hatred based on gender identity (art. 24 on freedom of the press, art. 6 of the law on confidence in the digital economy, art. L212-1 of the Internal Security Code). It allows trans people to change their first name and legal sex marker without being sterilized (law modernizing justice for the 21st century), invites educational personnel to respect the chosen first names of trans children (decision of 28 September 2022 of the Council of State), and obliges parents, supervising personnel, and healthcare professionals not to repress the gender identity of trans people, even if they are minors (2022 law banning conversion therapies).

The recognition of the existence of trans children is a prerequisite for any democratic debate concerning their care. They have specific rights: the first of these is recognition of their gender identity, that is, respect for their chosen first name, their pronouns, and their form of address.

They also have specific needs: at puberty, some adolescents experience an intensification of the distress they carry within. The social gaze on their evolving bodies traps them in a gender role they do not want. They may then seek ways to suspend or modify the course of their physical development in order to be recognized for who they are. Some of them want to be recognized as men, others as women, still others – non-binary youth – do not want to be recognized in either of those roles.

We must become aware of the strength and violence of the social gaze these young people experience. It is expressed everywhere: in their families, at school, in public spaces, in the healthcare and social support systems, on social media, but also in the press, on the radio, and on television. The French Virage LGBT survey shows the magnitude of this: 6 in 10 trans youth experience intrafamilial violence, 1 in 5 is excluded from the parental home, 8 in 10 trans people suffer violence in public spaces, and half of them experience sexual violence. A study by the European Union Agency for Fundamental Rights confirms: up to 5 in 10 trans people in France have faced discrimination from educational staff, and nearly a quarter have sought to leave school because they are trans. In a context where no space is safe for them, trans youth struggle to envision the future; 86 % of them have considered suicide, and 42 % have already attempted it (USTS 2015).

In these life-threatening circumstances, beset by harmful discourse and extreme violence, trans youth must be able to benefit from supportive and compassionate care. Support personnel must create protective environments where trans youth can live their identity in the present, whatever it may be. They should not predetermine the ultimate gender of the person or push them in a given direction, but rather open up a space of possibilities.

Providing a benevolent social environment for trans and gender-questioning youth means always leaving the door open to feelings of disappointment, regret, desires to choose a different transition pathway, or to revisit decisions. Open to the person’s experience, support personnel must listen openly to all the paths that youth exploring their gender wish to discover or rediscover.

Healthcare specific to trans adolescents is the subject of complex scientific and legal debates. Care providers must ensure the cognitive maturity of adolescents to whom they offer care and measure with them and their parents the benefit-risk balance of each care option. For example, puberty blockers have fully reversible effects and few side effects for adolescents; they allow more time to reflect on the transition pathway the young person wishes to pursue. Sexual hormones and surgery, however, have long-lasting effects and may entail side effects. Modern bioethical principles must be weighed together, confronted, and balanced.

Refusing to provide such care must also be evaluated: letting puberty proceed unchecked when medical resources are available to delay it for young people who suffer and request these treatments may be considered contrary to the medical ethical principles of beneficence, non-maleficence, autonomy, and justice.

The law holds that minor adolescent girls are autonomous enough to take contraceptive hormones, to have an abortion, or, conversely, to become mothers, without parental authority being able to know or intervene and without concerns about future regret undermining that right. What justice would there be in refusing to recognize the medical autonomy of minor adolescents who wish to transition? What name should we give to this irrational fear of gender transition, and to those who propagate that fear?

Trans youth exist. It is time to recognize their rights, to meet their health needs, to fight against the rejection of human diversity, against the disregard for universal rights, and against the gender stereotypes that confine us all.
